On July 25, 2013, American Roads LLC, and nine (9) affiliated companies (collectively, the “Debtors”), each filed voluntary chapter 11 cases in the United States Bankruptcy Court for the Southern District of New York (the “Court”) to consummate a prepackaged plan of reorganization that has been accepted by the only creditor entitled to vote on the plan. The Debtors’ cases have been assigned to Judge Burton R. Lifland. The Debtors are seeking to have their cases jointly administered for procedural purposes, meaning that upon entry of such an order all pleadings will be maintained on the case docket for American Roads LLC; Case No. 13-12412 (the “Main Case Docket”). The proposed plan of reorganization has been filed with the Court. The Main Case Docket can be accessed through the website maintained by the Court (http://www.nysb.uscourts.gov). A date for the meeting of creditors pursuant to section 341 of the Bankruptcy Code has not been established.
The deadline for the filing of proofs of claim against the Debtors in these cases has not been established by the Bankruptcy Court. The Debtors do not anticipate setting a deadline for filing proofs of claim.
